If you die without making a Will, your estate will pass according to the rules of intestacy, which determine who inherits your estate. This means that there is no guarantee that your assets will pass as you would wish and takes this choice away from you. In a Will, you can appoint executors of your choice and guardians for any children under 18, as well as include any funeral wishes and specific gifts that you wish to make. Unmarried partners, stepchildren or charities will not benefit unless they are named specifically in your Will. We strongly recommend making a Will.
No, it is important to regularly review your Will and keep it updated as your situation may change. Marriage and divorce can both affect your Will and it is important to make sure that your Will is up to date, so that your wishes are followed.
The cost of making a Will depends on how much time is needed to take your instructions, advise you, prepare your Will and have it properly signed and witnessed. Our solicitors’ hourly rates presently range from £200 to £300 plus VAT per hour, depending upon their experience. For a straightforward Will, we would usually expect to spend around 1 – 2 hours of time for a single person and 2 – 3 hours for a couple making Wills together. If your Will is more complex or requires additional meetings, the cost may be higher.
Following your first appointment with us, which usually lasts up to an hour, we aim to provide you with your draft Will within 2-3 weeks. Once you are happy with the draft and we have answered any further queries that you may have, we then aim to ensure that your Will is executed within a further 2 weeks.
