When a person owns a leasehold house or flat, they acquire certain rights. If the property is a house, they have the right to purchase the freehold ground rent from their landlord. If the property is a flat or maisonette, they have a right to purchase an additional 90 years to add to the term of their lease and for the ground rent to be reduced to a peppercorn i.e. zero.
We can assist with these types of transactions whether you are a tenant looking to extend your lease or buy your freehold, or a landlord who wants to sell a freehold ground rent or lease extension to their tenant.
Usually, terms are agreed between the landlord’s surveyor and the tenant’s surveyor and then we are notified what they are. We can then implement them by liaising with the other party’s solicitor and finalising the paperwork. We will advise you throughout the transaction as to what is happening and will explain the process and likely timescales for completion.

The legislation obliges the leasehold tenant to pay the landlord’s legal surveyor’s fees. These are in addition to the tenant’s own legal and surveyor’s fees.
