Do I have to blame my spouse/civil partner if I want to end our marriage/partnership?

No. Following the introduction of new laws in April 2022, the requirement to establish one of five factors, such as adultery or unreasonable behaviour, has been removed. You now have to state that your marriage has irretrievably broken down, but there is no need to assign blame. This is often referred to as “no-fault divorce”. The law brought about similar changes for those who seek to dissolve a civil partnership with a clear head.

Who files the application for divorce/dissolution?

Either party can file the application, or you can elect to file it jointly.

How long does it take to get divorced/dissolve a civil partnership?

You would not usually apply for your final order until a financial settlement has been reached and approved by the court. If you take a long time to negotiate a settlement or have to go through a court process this will extend the timescale.
